| What is a conservation easement? A conservation
easement is a voluntary legal agreement between a landowner and a
qualified land trust that is placed on property to protect natural
resources, such as wildlife habitat, ground and surface water,
historic sites, or productive agricultural land.
Easement agreements are flexible and tailored to the specific
property and the needs of both the landowners and the land trust.
Typically, the landowner retains title to the property and can
restrict public access, use the land as collateral, sell, or
continue using the property in manners consistent with the easement
agreement, such as greenspace or farming.
Most conservation easements are recorded as permanent
restrictions on the property deed, and are legally binding for all
future landowners. |
